Terms of Service

1. Acceptance of Terms

By accessing or using PinLeads ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and PinLeads regarding your use of the Service.

Eligibility: You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into these Terms.

2. Description of Service

PinLeads is a web-based data extraction tool that allows users to scrape publicly available business information from online directory listings. The Service extracts data including but not limited to business names, addresses, phone numbers, email addresses, website URLs, and LinkedIn profiles.

Service Availability: We strive to maintain the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

Modifications: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

3. Third-Party Integrations

PinLeads offers optional integrations with third-party services including HubSpot and Zapier. By connecting these integrations, you acknowledge and agree that:

• PinLeads is not affiliated with, endorsed by, or sponsored by HubSpot, Zapier, or any other third-party service
• You are responsible for complying with the terms of service and privacy policies of any third-party services you connect
• Data sent to third-party services is governed by their respective privacy policies and terms
• PinLeads is not responsible for the actions, policies, or practices of any third-party services
• You grant PinLeads permission to access and use your third-party service accounts solely for the purpose of providing the integration functionality
• You may revoke integration access at any time through your Account settings

HubSpot Integration: When you connect HubSpot, you authorize PinLeads to create and update contacts and companies in your HubSpot account using OAuth 2.0. You remain responsible for ensuring your use of scraped data complies with HubSpot's Acceptable Use Policy.

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password for your account
• Not share your account credentials with any third party
• Notify us immediately of any unauthorized use of your account
• Ensure that you log out from your account at the end of each session

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms. You may also delete your account at any time through your account settings.

4.4 Account Limits

To ensure fair use and prevent abuse, users are limited to one free account per device and IP address combination within any 30-day period. Attempting to circumvent this restriction by creating multiple accounts is prohibited and may result in account suspension or termination. Deleting your account and creating a new one from the same device within 30 days is not permitted.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Service for the following purposes:

• Generating business leads for legitimate commercial purposes
• Conducting market research and competitive analysis
• Building business directories and contact databases
• Finding potential customers, partners, or suppliers
• Academic research (provided it complies with all applicable laws)

5.2 Prohibited Uses

You expressly agree NOT to use the Service for:

• Sending unsolicited commercial communications (spam)
• Harassing, stalking, or intimidating individuals or businesses
• Engaging in any illegal activities or violating any laws
• Violating online directory Terms of Service or engaging in activities that could result in service providers blocking our Service
• Reselling or redistributing scraped data without adding significant value
• Attempting to circumvent usage limits, security measures, or access controls
• Using the Service to collect data about minors or for predatory purposes
• Creating fake accounts or engaging in fraudulent activities
• Interfering with or disrupting the Service or servers
• Attempting to reverse engineer or extract source code

5.3 Rate Limits and Fair Use

We implement rate limits to ensure fair use and Service stability. Excessive usage that negatively impacts Service performance is prohibited. We reserve the right to throttle or suspend accounts exhibiting abusive usage patterns.

6. Subscription Plans and Payments

6.1 Plan Descriptions

We offer the following subscription plans:

• Free Plan: 30 minutes of scraping time per month at no cost
• Pro Plan: Starting at $9.99/month for 10 hours of scraping time and enhanced features
• Business Plan: Starting at $29.99/month for 40 hours of scraping time and priority support

6.2 Billing and Renewal

Subscriptions automatically renew monthly unless cancelled. You authorize us to charge your payment method for all applicable fees. All payments are processed securely through Stripe.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused scraping time.

6.4 Price Changes

We reserve the right to modify subscription fees with 30 days advance notice. Price changes will take effect at the start of the next billing cycle after the notice period.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of PinLeads and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

7.2 Your Data

You retain all rights to the data you generate using the Service. You grant us a limited license to process this data solely for the purpose of providing the Service to you.

7.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without restriction or compensation to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of scraped data

Data Accuracy Disclaimer: While we strive for accuracy, PinLeads cannot guarantee that all extracted data is current, correct, or complete. Business information changes frequently. You are solely responsible for verifying the accuracy of data before use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PinLeads and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or goodwill
• Business interruption or loss of business opportunities
• Personal injury or property damage
• Any other intangible losses

Our total liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless PinLeads and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Your conduct in connection with the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• All licenses granted to you will terminate
• We may delete your account data (subject to our Privacy Policy)
• Provisions intended to survive termination shall remain in effect

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

For significant changes, we will provide at least 30 days' notice before the new terms take effect. If you do not agree to the new terms, you must stop using the Service.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PinLeads regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
